Commercial Litigation Barristers for Birmingham clients

Birmingham is the largest commercial court centre in England outside London. The Birmingham Civil and Family Justice Centre on Bull Street houses the County Court at Birmingham, the Birmingham District Registry of the High Court and the Business and Property Courts in Birmingham. Between them these venues carry a very substantial share of the Midlands commercial disputes docket, from mid market contract claims through to complex trust and insolvency work.

Clerk and Counsel is a clerking agency, not a chambers. We place independent, self employed commercial barristers from the Midland Circuit and the London Bar on Birmingham commercial disputes. Our role is to identify counsel who fit the case, the court, the timetable and the budget, and to get the engagement letter and conflict checks done quickly so counsel can start work.

Instructions come from Birmingham commercial solicitors, from in house teams across the wider West Midlands manufacturing and professional services base, and directly from company directors, shareholders and SMEs using the Public Access scheme. Where Public Access is not appropriate we say so at the first call and, where useful, suggest a solicitor to lead the file with counsel kept in reserve.

For urgent applications, freezing orders, contested winding up petitions and short notice injunction hearings, counsel can usually be briefed within twenty four to forty eight hours. For pleadings, advice on merits and case strategy work the engagement letter is normally issued within two to three working days of the initial brief.

Courts and venues

Where these cases are heard

The Birmingham Civil and Family Justice Centre at Priory Courts, 33 Bull Street, Birmingham B4 6DS is the primary civil hearing venue for the West Midlands. It houses the County Court at Birmingham, the Birmingham District Registry of the High Court and the Business and Property Courts in Birmingham.

The Birmingham B and PC covers the Chancery, Business, Commercial, Technology and Construction and Insolvency and Companies lists. Heavier and cross border matters are still occasionally transferred to the Rolls Building in London, but the growing tendency is to keep Midlands disputes in Birmingham.

Lower value civil work is also heard at County Court hearing centres across the West Midlands including Coventry, Wolverhampton, Worcester, Stoke on Trent and Nuneaton. Interim hearings frequently run remotely on CVP and Teams, which allows us to place London counsel on Birmingham matters without full travel time added to the fee.

Local context

What drives this work in Birmingham

Birmingham commercial work is driven by three overlapping economies. The city has a substantial professional and financial services cluster in and around Colmore Row and Snow Hill, a long standing manufacturing and engineering base across the Black Country and the wider West Midlands, and a fast growing digital, creative and life sciences sector supported by the universities and Innovation Birmingham.

That mix produces a steady flow of shareholder fallouts in owner managed businesses, supply chain and warranty disputes among manufacturers, contested insolvencies and directors disqualification work, and a growing volume of restrictive covenant and team move disputes as staff churn increases across the professional services base.

Public Access enquiries from Birmingham are dominated by SME directors, family businesses in dispute, and individuals defending guarantees, contract claims or bankruptcy petitions. In each case we look first at whether the matter can be run on Public Access with counsel taking the lead, and only escalate to a full solicitor led model where the evidence base or disclosure burden makes that essential.

Fees

What instructing counsel costs

Fees on Birmingham commercial work are agreed in writing before any work begins. Written advice on merits typically runs between six hundred and two thousand pounds plus VAT depending on document volume. Drafting a Particulars of Claim or Defence for a mid market contract dispute is usually in the range of one thousand two hundred to four thousand pounds plus VAT.

Hearing fees at the Birmingham Civil and Family Justice Centre run from around eight hundred pounds plus VAT for a shorter interim application through to three thousand five hundred pounds plus VAT for a full day multi track hearing with senior counsel. Freezing order and urgent injunction work is priced separately and includes evening and weekend availability where the matter requires it.

For SMEs handling their own disputes we will always try to work to a fixed fee for each stage so that the exposure is capped and visible on day one, rather than an open ended hourly commitment.

If you have a Birmingham commercial dispute that needs counsel, send us a brief and we will come back with a shortlist, an indicative fixed fee where Public Access fits, and confirmation of conflict check timing.

Every barrister we place is regulated by the Bar Standards Board. Clerk&Counsel is a clerking agency and does not provide legal services itself.
